TERMS AND CONDITIONS

The term "Exhibitor" means the signatory of this contract and shall include all employees, servants and agents of any company or joint venture of, firm or individual who will participate in any or all elements of and to whom space has been allocated for the purposes of exhibiting at ICE Events.

The term "Exhibition" shall mean the event and all subsequent activities referred to and described on the application form. The Education Fair and Event are used as identical and interchangeable terms.

The term "Organizer" shall mean International Center For Education Inc. (ICE) and its Directors, employees and personnel.

  1. Payment by the Exhibitor confirms acceptance of the Terms & Conditions and is binding upon the Exhibitor.

  2. All wait listed/interested institutions and organizations will be notified if space becomes available after the official closing date and will be offered the right of first refusal. Registration will be confirmed only upon receiving full payment.

  3. Cancellation(s) should be made by fax or by e-mail to the Home Office and no refunds will be entertained /valid within 120 days of the event. ICE reserves the right to claim full rental if cancellation is not done in writing on or before the said date. All reasonable attempts will be made to honor a refund request after the deadlines in extreme situations

  4. The agreement to exhibit is irrevocable by the Exhibitor with the exception of the 120 day clause; however, at its discretion the Organizer may cancel the contract or refund payments already made.

  5. Only products/materials and institution's names entered on the application form will be displayed at the event. No sub-letting or exchange of any part of the space applied for will be permitted. Electrical items are permitted upon prior notification and outlets will be provided at no additional cost.

  6. Booth setups should be completed 1 HOUR prior to the opening on the days of the Education Bazaar. The Organizer reserves the right to close the booth or deal with it any way they deem fit after such deadline has passed.

  7. Exhibitors are responsible for the safety of their exhibits, employees, public and themselves before/during/after the event. Exhibitors are not permitted to conduct demonstrations using live fire or heated oil. The Organizer does not accept responsibility and/or any liability for loss or damage whatsoever caused to any exhibit, property of any Exhibitor or general public and discharge themselves of any liability, financial, legal or otherwise.

  8. Exhibitors are not allowed to bring into the Exhibition area or booth any exhibit/animals or reptiles or substance which are liable to cause harm to the public or cause an explosion. The Organizers may in their absolute discretion demand the removal of, or take steps themselves to remove, any such exhibit or substance at the Exhibitor's expense.

  9. Exhibitors are not permitted to consume alcoholic beverages during the Exhibition and the Organizer discharges themselves of any liability, financial, legal or otherwise and will not be held responsible for damages caused in any way, shape or form.

  10. Organizer will not be held responsible for misunderstandings and disputes, legal or otherwise caused from or arising to address the situation.

  11. Only approved contractors may be used for any electrical and booth building work and use of lifting apparatus.

  12. The Organizer shall not be held responsible for the loss or damage to any property of the Exhibitor or any person before/during/after the exhibition caused by theft, fire, defect in the Exhibition Hall, storm, tempest, lightning, national emergency, national mourning, civil unrest, war, labor disputes, lockouts, explosions, terrorism, acts of God and general cause of force majeure with foregoing or any cause not within the Organizer's control or for any loss or damages sustained in the event that the opening or holding of the Exhibition is cancelled, prevented, postponed or abandoned for any loss or damage to the basic structure of the exhibit. Exhibitors are advised to take out appropriate insurance for the purpose of indemnifying the Organizer as aforesaid and also cover themselves against all risks anticipated or associated with their participation and, more explicitly, in respect of those conditions for which the Organizer has discharged themselves.

  13. In no event shall the Exhibitor have any claim for damages of any kind against the Organizer in respect of any loss or damages consequent upon cancellation, breakdown, prevention, postponement or abandonment of the Exhibition due to the occurrence of any of the events referred to above or reasons beyond the control of the organizer. The Organizer shall be entitled to retain all sums paid by the Exhibitor or such part thereof as the Organizer shall deem fit. If in the opinion of the Organizer by rearrangement or postponement of the Exhibition or by substitution of another hall or building or in any other reasonable manner, the Exhibition can be carried out, these conditions shall be binding upon the parties.

  14. The Exhibitor shall hold the Organizer safe and harmless from all loss or damages suffered directly or indirectly arising out of any act or negligence beyond the control of the organizer and discharges the organizer of any legal or financial claims.

  15. All display, advertising exhibits and booth arrangements shall be appropriate to suit the nature of the Exhibition and of a reasonable high standard. Additionally, it shall not contravene or conflict with any moral or local custom and if otherwise, the Organizer may direct the Exhibitor to rectify any such breach and the Exhibitor shall act accordingly and immediately.

  16. In the event of a breach of any conditions for participation or payment, the Organizer reserves the right in all cases to retain all monies paid by the Exhibitor and have a lien/retain all goods of the Exhibitor and at the discretion of the Organizer, auction or sell goods of the Exhibitor to recover any amount due the Organizer and recover further money from the Exhibitor as provided herein along with storage, transportation, legal or other charges associated with the same.

  17. An attendee manual or floor plan may be issued by the hosting facility to the Exhibitor containing logistic information for participation at the event. All conditions and details contained therein are binding on all Exhibitors and appointed agents.

  18. It is the exhibitor's responsibility to verify the proper electrical supply and charge used at the event and make necessary arrangements to convert any electrical appliances to conform.

  19. The Organizer cannot accept any complaint or claim against them unless submitted in writing within 2(two) days after the closing of the Expo. Moreover, any theft claim, which requires to be reported to official authorities by the organizer, should be submitted on the same day of the theft/claim along with relevant supporting details and insurance certificates.

  20. Payments must be remitted in full within 15 business days of registration. Every effort will be made to accommodate special payment arrangements, if requested and must be submitted in writing for consideration.

  21. Organizer does not accept responsibility for no show by advertised personalities however all reasonable efforts will be made to facilitate their appearance.

  22. This agreement is full and complete in all its clauses and any modifications by the Exhibitor will nullify this contract and subject payments made thus far to forfeiture.

    Withdrawal by Exhibitor:

    Without prejudice to the rights and remedies of the Organizer in respect of any breach of the Contract on the part of the Exhibitor, the Organizer may at their discretion allow the Exhibitor to withdraw from the Exhibition subject to written advance notice to the Organizer that s/he desires to withdraw from the exhibition and cancel their request for participation. If the Organizer allows such withdrawal they will notify the Exhibitor of their decision in writing. Any such notification by the Organizers to the Exhibitor will constitute a cancellation of the contract, and shall include a specific amount to be paid by the Exhibitor to the Organizer in consideration for their release from the contract, as per the following proportion:

    Notice received 180 days before the exhibition:                  75% refunded.
    Notice received 120 days before the exhibition:                  50% refunded.
    Notice received less than 120 days before the exhibition:    No refund.
